These Terms of Service ("Terms") govern your use of the Nova voice assistant software ("Nova", "the Software") and the Nova website at nov-assistant.com ("the Website"), operated by Escipion ("we", "us", "our").
By downloading, installing, or using Nova, you agree to these Terms. If you do not agree, do not use the Software.
1. The Software
Nova is an open-source, locally-run AI voice assistant. The core software is provided free of charge under the MIT License. You may use, copy, modify, and distribute it in accordance with that license.
2. Nova Pro (Paid Membership)
- Nova Pro is an optional paid subscription that provides access to premium features including cloud hybrid mode, premium voices, multi-agent delegation, and priority support.
- Subscriptions are billed monthly through Ko-fi or PayPal.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
- Refunds are handled on a case-by-case basis. Contact us if you have concerns.
- We reserve the right to change pricing with 30 days' notice to existing subscribers.
3. Acceptable Use
You agree not to:
- Use Nova for any illegal purpose or in violation of any applicable laws
- Attempt to reverse-engineer, compromise, or disrupt any paid services or infrastructure
- Misrepresent your identity or affiliation when contacting support
- Redistribute Nova Pro features or access to non-paying users
4. Privacy & Data
- Local processing: Nova's core runs entirely on your device. Your voice data, conversations, and screen captures are processed locally and never sent to our servers.
- Cloud hybrid mode (Pro): If you enable cloud mode, your queries are sent to third-party AI providers (e.g., OpenAI). Their privacy policies apply to that data.
- Website: We may use basic analytics (page views, country) to improve the site. We do not sell your data.
- Payments: Payment processing is handled by Ko-fi and PayPal. We do not store your payment details.
5. Disclaimer of Warranties
Nova is provided "AS IS" without warranty of any kind, express or implied. We do not guarantee that the Software will be error-free, uninterrupted, or meet your specific requirements.
AI-generated responses may be inaccurate, incomplete, or inappropriate. You are responsible for how you use the output.
6. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Nova, including but not limited to loss of data, loss of profits, or business interruption.
7. Open Source
The core Nova software is open source under the MIT License. These Terms apply in addition to (not instead of) the MIT License for the open-source components.
8. Changes to Terms
We may update these Terms at any time. Significant changes will be communicated via the Website or GitHub repository. Continued use after changes constitutes acceptance.
